The 35 kmh is more of a theoretically safe maximum value. The circuit board sends the scooter the command to drive 35 kmh. The scooter then uses 350W power if possible until 35 kmh is reached. But the 350W is often not enough to achieve more than 30 kmh.
Depending on the manufacturing tolerance of the motor and luck, you can achieve more or less speed with the 350W.
The scooter uses the circuit board to achieve the maximum that the hardware allows.
